These Terms and Conditions explain the rules that apply when you use our website, browse our store, create an account, place an order or purchase products from paceon.co.uk.

In these Terms, “PACEON”, “we”, “us” and “our” refer to PURA VIDA ECOM SOLUTIONS LTD trading as PACEON. “You” and “your” refer to the customer, visitor or user of our website.

PACEON is powered by Shopify, which provides the e-commerce platform that allows us to sell our products and services to you.

Please read these Terms carefully before using our website or placing an order. By accessing our website or purchasing from us, you agree to these Terms, together with any policies referenced in them, including our Privacy Policy, Cookie Policy, Shipping Policy and Returns, Exchanges & Refund Policy.

These Terms do not affect your statutory rights as a consumer.

You may use our website for lawful personal shopping purposes only.

You must not use our website:

  • for any unlawful, fraudulent or harmful purpose;
  • to breach any applicable laws or regulations;
  • to interfere with the security, performance or availability of the website;
  • to transmit viruses, malware or harmful code;

However, product colours and appearance may vary slightly depending on your device, screen settings, lighting and image display. Product measurements and descriptions are provided to help you make an informed purchase but may be approximate.

All products are subject to availability. We may change, update, limit or discontinue products at any time.

We reserve the right to correct product descriptions, pricing, images, availability, promotions or other website content where errors or omissions occur.

4. Product sizing and fit

Footwear sizing and fit can vary between styles, brands, materials and product types.

Where available, we provide size guides and product information to help you choose the most suitable size. These are provided as guidance only and do not guarantee a perfect fit.

5. Orders and contract formation

When you place an order through our website, you are making an offer to purchase the products in your basket.

After you place an order, you may receive an order confirmation email. This confirms that we have received your order request, but it does not necessarily mean that your order has been accepted.

Your order is accepted when we dispatch the goods or send you a dispatch confirmation. At that point, a contract is formed between you and PACEON.

We may refuse, cancel or amend an order before acceptance where reasonable, including where:

  • the product is out of stock;
  • there is an error in pricing, description or availability;
  • payment is declined or cannot be verified;
  • the delivery address is incomplete, inaccurate or outside our delivery area;
  • we suspect fraud, misuse or unauthorised payment activity;
  • the order appears to be for unauthorised resale or commercial use.

If we cancel an order after payment has been taken, we will issue a refund to the original payment method, unless another lawful arrangement has been agreed.

6. Personal use and resale

Our website is intended for consumer purchases for personal or household use.

You must not purchase products from PACEON for unauthorised resale, export, marketplace listing or commercial distribution without our prior written permission.

7. Prices and payment

All prices on our website are shown in pounds sterling (£ GBP), unless clearly stated otherwise.

Prices, discounts, promotions and product availability may change at any time. The price you pay will be the price shown at checkout when you place your order, subject to our right to correct obvious errors.

Delivery costs, where applicable, will be shown before you complete your order.

We accept payment methods made available at checkout, which may include Shop Pay, Visa, Mastercard, American Express, Diners Club, Discover, Apple Pay, Google Pay, Amazon Pay and PayPal.

Shop Pay instalment options, where available, are provided by the relevant payment provider and may be subject to eligibility checks, approval, separate terms and availability.

For approved B2B orders, alternative payment methods may be available by prior agreement.

You confirm that you are authorised to use the payment method provided and that all payment information is accurate and complete.

8. Promotions, discount codes and offers

From time to time, we may offer promotions, discounts, bundles, sale pricing, free delivery offers or other incentives.

Promotions may be subject to separate terms, including start and end dates, minimum spend, product exclusions, availability and usage limits.

Discount codes must be entered correctly at checkout and cannot usually be applied retrospectively after an order has been placed.

We reserve the right to withdraw, amend or refuse a promotion where it is being misused, applied in error, or used contrary to its terms.

9. Shipping and delivery

We currently sell and deliver to customers in the United Kingdom only.

Orders are usually processed within 1 business day, excluding weekends and public holidays.

Our current UK delivery options are:

  • Standard UK Delivery: free of charge, estimated at 7–9 business days after dispatch.
  • Express UK Delivery: £9.99, estimated at 5–7 business days after dispatch.

Delivery timeframes are estimates and may be affected by courier delays, high-demand periods, public holidays, weather, operational issues or events outside our reasonable control.

We will deliver your order to the delivery address provided at checkout. You are responsible for ensuring that your delivery address is accurate and complete.

Risk in the goods passes to you when the goods are delivered to you, or to a person identified by you to receive them.

10. Cancellations, returns, exchanges and refunds

Your rights to cancel, return, exchange or receive a refund are set out in our Returns, Exchanges & Refund Policy.

If you are a consumer in the United Kingdom, you have the legal right to cancel your online order within 14 days of receiving your goods, without giving a reason. Once you have told us that you wish to cancel, you then have a further 14 days to send the item back.

Items must be returned in accordance with our Returns, Exchanges & Refund Policy.

Footwear may be tried on indoors in the same way you would try it on in a shop. However, if an item is returned used, damaged, marked, incomplete or handled beyond what is necessary to inspect it, we may reduce the refund to reflect any loss in value.

For returns due to a change of mind, incorrect size selection, colour preference or personal preference, you are responsible for the cost of return shipping.

If the item is faulty, damaged, incorrect or not as described, we will handle the matter in accordance with your legal rights.

11. Faulty or misdescribed products

We are committed to supplying products that are as described, of satisfactory quality and fit for their intended purpose.

If you believe an item you received is faulty, damaged, incorrect or not as described, please contact us as soon as possible at contact@paceon.co.uk with your order number, a description of the issue and photos where appropriate.

Nothing in these Terms limits or excludes your statutory rights in relation to faulty, damaged, incorrect or misdescribed goods.

12. Reviews, feedback and user content

You may be able to submit reviews, ratings, photos, comments, feedback or other content through our website, emails, review platforms or social media.

By submitting content to us, you confirm that:

  • the content is accurate and based on your genuine experience;
  • you have the right to submit it;
  • it does not infringe anyone else’s rights;
  • it is not unlawful, abusive, defamatory, obscene, misleading or harmful;
  • you have disclosed any incentive or compensation received in connection with the content, where applicable.

You grant PACEON permission to use, reproduce, publish, display, edit and share your submitted content for business, marketing, customer service and promotional purposes, including on our website, emails, social media and advertising, subject to applicable law.

We may moderate, remove or refuse to publish content where we reasonably believe it breaches these Terms, is misleading, unlawful, offensive or inappropriate.

All content on our website, including text, images, graphics, logos, product descriptions, design, layout, icons, videos, photography, branding and software, belongs to PACEON, our licensors, Shopify or other relevant rights holders.

You may use our website for personal shopping and browsing only. You must not copy, reproduce, distribute, modify, republish, scrape, sell, exploit or use any part of our website or content for commercial purposes without our prior written permission.

PACEON’s name, logo, branding, product names, designs and slogans may not be used without our prior written consent.

14. Third-party tools, links and services

Our website may include links, tools, apps, payment options, embedded content or services provided by third parties, including Shopify, payment providers, analytics providers, advertising platforms, review platforms and delivery partners.

Third-party services may be subject to their own terms, privacy policies and practices. We are not responsible for third-party websites or services that we do not control.

If you choose to access third-party links or services, you do so at your own discretion and should review their terms and policies carefully.

15. Relationship with Shopify

PACEON is powered by Shopify, which enables us to provide our online store and related e-commerce services.

However, any sales and purchases made through our website are made directly between you and PACEON. Shopify is not responsible for the products you purchase from us or for any aspect of the sales contract between you and PACEON.

Your use of our website is also governed by our Privacy Policy and Cookie Policy.

These explain how we collect, use, store and share personal information, and how we use cookies, pixels and similar technologies.

We reserve the right to correct errors, update information, amend orders or cancel orders where reasonable and lawful, including after an order has been submitted but before it has been accepted.

If we cancel an order because of an error and you have already paid, we will refund the amount paid to your original payment method.

We may refuse, hold, cancel or request further verification for an order where we reasonably suspect fraud, unauthorised payment use, chargeback risk, address mismatch, identity misuse or other suspicious activity.

Nothing in these Terms limits or excludes liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability that cannot be excluded or limited under applicable law.

We are responsible for foreseeable loss and damage caused by us breaching these Terms or failing to use reasonable care and skill.

We are not responsible for losses that are not foreseeable, or for business losses suffered by consumers, including loss of profit, loss of revenue, loss of business, business interruption or loss of business opportunity.

Our products are supplied for domestic and private use. If you use products for commercial, business or resale purposes without our prior written agreement, we will not be liable for business-related losses.

21. Events outside our control

We are not responsible for delays or failures caused by events outside our reasonable control. This may include courier disruption, strikes, transport delays, extreme weather, natural events, technical failures, supply chain disruption, public health events, government action or other circumstances beyond our control.

If such an event affects your order, we will contact you where reasonable and take steps to minimise the impact.

22. Indemnity

You agree to compensate us for reasonable losses, damages, liabilities, costs or expenses arising from your unlawful use of our website, your breach of these Terms, your misuse of our services, or your infringement of third-party rights.

This section does not affect your statutory rights as a consumer.

If any part of these Terms is found to be unlawful, invalid or unenforceable, that part will be treated as removed to the minimum extent necessary. The remaining parts of these Terms will continue to apply.

If we do not immediately enforce any right or provision under these Terms, this does not mean that we have waived that right or provision.

You may not transfer your rights or obligations under these Terms to another person without our prior written consent.

26. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales.

If you are a consumer living in another part of the United Kingdom, you may have the right to bring legal proceedings in your local courts.

Nothing in this section affects any mandatory consumer rights you may have under applicable law.

The latest version will always be posted on this page with the updated date shown above.

Your continued use of our website after changes are posted means that you accept the updated Terms. Any order you place will be governed by the Terms in force at the time you place that order.
